“As a result of my campaign for SFWA president, I have spent the last two months in the bowels of the SFWA forums. What I have seen is that the writers who make up the SF/F community are, to an almost unbelievable extent, delusional.  They genuinely believe they are faster when they have been winning races because a vast quantity of other runners have been barred from even lining up in the blocks to run against them.  They genuinely believe that they are special beings with a superior morality, and at the same time, assert that their ideological views are shared by all the decent members of civil society. And they are very nasty pieces of work, bitter from their long experience of social exclusion and their lowly positions on the socio-sexual totem pole.  They are full of hatred themselves, which is why they see hate in even the most genuine and harmless differences of opinion.

Most of all, they have no ability to conceive of the mere possibility of separating the personal from the political. They attempt to destroy those who disagree with them or cause them to suffer embarrassment; recall that McRapey’s charity campaign wasn’t an attempt to stop me from trolling his blog or to advance any racist, sexist, or homophobic causes, it was to try to stop me from simply mentioning him because I dared to directly quote him and taunt him for his eminently tauntable words. I did nothing more than do to him what he prides himself on doing to others; you all know what resulted from that.

Nearly two decades ago, a member of the SFWA told me that the battles within science fiction were so bitter because the stakes were so small. But I think he was wrong. It’s more than that. The battles are so bitter because SF/F is largely comprised of gamma males and unattractive women who are very bitter people.  They are openly bitter about their lots in life. They are deeply angry with the world as they have experienced it. The books they write, for the most part, are their wish fulfillment fantasies, places where they finally have the chance to say what they didn’t have the wit to say when it mattered and be the people they couldn’t manage to become in real life. This is why, despite being technically more proficient in some ways, their work is so observably inferior to the science fiction and fantasy of earlier ages that concerned itself with ideas of more grandeur and societal import than the retro-adolescent daydreams of socio-sexually unsuccessful former junior high school students.

I commend Sarah for her graciousness in attempting to warn those who have repeatedly done their best to professionally shun her and undermine her career. But I can tell her that it will not work; I attempted to do something similar in my current campaign for SFWA President. But my warnings about the coming collapse of the traditional professional publishing business of SF/F – which you will note preceded the failure of Night Shade Books – was met with little more than the usual sneers and rabbits shrieking ‘not-rabbit, not-rabbit’!”

Part IV: Organizational Partisanship & Biasness – The Need for Change Within the SFWA

Another necessary concern regarding the SFWA 2013 Elections to consider is the ongoing negative blog postings relative to Theodore Beale. As stated previously, the negativity is reaching the level that caused the Bauer vs. Glatzer[1] lawsuit. What’s next on the horizon?

Will the Defendants in the Bauer case and their minions create a list of the “20 Worst Candidates for SFWA for SFWA President”?

Will the Defendants in the Bauer case and their minions create YouTube videos to humiliate Theodore Beale?

Will the Defendants in the Bauer case and their minions resort to the same tactics that led to the lawsuit against them?

Will the Defendants in the Bauer case and their minions resort to boycotts of Theodore Beale’s books?

Will the Defendants in the Bauer case and their minions resort to creating a “Thumbs Down” list for SFWA candidates that they deem undesirable?

Many of these individuals have already had their fair share of lawsuits and cease & desist requests.  However, there is a very qualified difference here. As an example, what Bauer vs. Glatzer lacked in terms of prosecution, it made up for in terms of customary (anticipated) blogger commentary and potential liability; unfortunately most of them have not learned their lesson yet. Moreover, new case law is always being developed regarding this kind of activity and the Teflon is getting thinner. Someone with in this group of mashuganas is going to eventually take the fall . . .  and it’s going to be a big fall.

It will be interesting to watch how this continues to play out . . . both pre-election and post election. Could Theodore Beale consider possible legal action against these Internet posters? Will it be another Cretella v. Kuzminski (i.e. The Case Against Preditors & Editors David L. Kuzminski)? Will it reach this level? Are slander and defamation actions imminent? Could Beale establish a claim for loss of opportunity?

It’s interesting to ponder these scenarios; even if they are hypothetical. However, generally speaking, most of the comments currently being made by independent bloggers would most likely not be cloaked with the protections of the Communication Decency Act (CDA 230) which protected Wikipedia but not necessarily the remaining defendants in the Bauer case; nor did it completely exonerate them.

In Part III of this series, we indicated that John Scalzi was no Moses. By contrast, Moses gathered people together; he fused people and created a communal entity far more than a collection of individuals.

A group that gathers together can also move apart, and even while together, the union is not compete; an examination of the SFWA voting history clearly supports the notion that it has become segregated. There doesn’t appear to be any spirit of unity. What, if anything, binds and unifies the members of the current SFWA? How defunct is an organization where its President (Scalzi) is elected on only 11% of the entire possible vote?

Moses was the epitome of self-transcendence; every aspect of his being was committed to others. He was able to inspire transcendence. Moses has been described as a shepherd. He infused harmony even when facing different factions or contrary opinions. The establishment of unity among the membership is essential to the health of organization. The more that a leader is able to develop his/her own harmony, he/she will be more open to others and be willing to relate to them as equals. This will encourage the expression of the inner bond that all members should share . . .  versus being in a constant state of discord. What motivates a leader to rise above their personal agendas? A leader’s service should begin with marshalling the different aspects of their own being first. Then, and only then, can the organization work towards unity and harmony.

The dreadful reign of John Scalzi is finally coming to an end. Selah! Change is also coming to the SFWA. The pending election will either result in “sweeping” change or simply a change in leadership. This is not merely a promise; this is something that can be anticipated today. Regardless of who may ultimately win the 2013 SFWA Presidential Election, Theodore Beale or Steven Gould, either of them has the potential to establish a new harmony within the organization (SFWA) and to spread that harmony among the membership. Moreover, both candidates have the opportunity to create sweeping changes within the SFWA and shed the tarnished image left by the Scalzi and his minions:

“Scalzi, current president of the Science Fiction and Fantasy Writers of America, responded by calling [Beale], ‘a jackass, and a fairly ignorant jackass at that.’”

Elections, and organizational change, represent the opportunity to search. The need to search is not a choice but a necessity. The search is personal (i.e. within the SFWA membership) as well as institutional. The process of searching gives all members the opportunity to take corrective measures (voting), find what is missing and identify the needs of the organization.

I’ve never expected SFWA to do anything for me because I require nothing from it. However, I have the luxury of regarding my membership as an affectation; other members of SFWA might actually want it to do something useful for them. I happen to think SFWA can be useful; I happen to think it doesn’t do a particularly good job of being useful.[Emphasis added]

Contrary to John Scalzi’s dogma, dues-paying members of any organization do expect something in return; something far beyond a mere “affection.” Organizations have a purpose to establish a “commonwealth” . . .  something for the greater good . . . for its members, not something that an elected official can be half-heartedly dedicated to. Admitted, Scalzi was honest about this point and where his priorities stood:

I’ve been a SFWA member long enough to know that it’s a fairly thankless position, with lots of herding cats and dealing with aggravating minutiae, and I have a career to look after at the moment. [Emphasis added]

 In conclusion, the huge difference in these organizational elections is that they do not include political parties . . . they involve people . . . human beings. Accordingly, they should be civil and partisan. This particular race for SFWA President is turning into something very political . . . with the same cast of characters showing their true colors again. However, it’s unique that the negative attacks are being waged against one of their own . . . Theodore Beale. Theodore Beale’s only crimes are that he writes controversial pieces and that he disagrees with John Scalzi. Being controversial is nothing new when it comes to past (or present) SFWA Presidents. Why is it such a big issue now? Unfortunately, this whole ordeal is making Scalzi and his minions look like a bunch of schlemiels.

John Scalzi had the opportunity to stand up (for once) and demonstrate that he had true leadership qualities. Criticism and contrary opinion are to be expected for elected officials . . .  Scalzi doesn’t appear to have learned that lesson. Instead, in a very farcical move, Scalzi has rose up in opposition to Beale by publically endorsing Steven Gould; not a very “Presidential” maneuver when an unbiased stance would have given him the appearance of being a leader. However, Beale has given us all a glimpse of how “Presidential” he is. We do not ever recall an outgoing president of the SFWA to have ever publically endorsed one candidate over the other. Again, John Scalzi never was and never will be a Moses.

People join organizations, such as the SFWA, to have a voice, to be represented and to be members of a group. This 2013 election is the perfect time to deliver the SFWA from the mindsets of the likes of Scalzi and readjust so that it can take on a more purposeful mindset. In choosing our leaders, we should not select only those who are like us in temperament and personality. Nor should we choose only those who act in a certain way that we find agreeable to our personal lives and acceptable standards. In selecting the next SFWA President you will have to abandon your proneness to conformity and/or complacency.

Educate yourself and vote accordingly . . .  but DO VOTE and encourage other SFWA members to vote.

Petit is also believed to be an Absolute Write contributor and frequent commenter on Writer Beware ™. Confidential sources indicated to The Write Agenda that, at one time, all complaints and “cease & desist” letters regarding Writer Beware™ were to be directed to Charles E. Petit. On information and belief, it appears that he did accept service of process for several defendants in the Bauer vs. Glatzer in 2007. Petit never actually represented any of the defendants. He couldn’t because he’s not licensed in New Jersey. He did accept service and then referred the case to local New Jersey attorneys. He was subjected to disciplinary action, by the Illinois Attorney Registration and Disciplinary Commission, after a complaint was filed by Nancy Steinbeck who was the former wife of John Steinbeck IV, the son of author John Steinbeck.As of this writing, Charles E. Petit has not made any effort at restitution or returning the fees that he collected from Nancy Steinbeck.

Tate Publishing & Enterprises, LLC Slams Author P.N. Elrod With a “Another” Cease & Desist Order

An anonymous source has advised The Write Agenda™ (TWA) that Author P.N. Elrod was hit with “another” cease and desist order.

Apparently, numerous Tate Publishing authors, with Facebook and other electronic services, provided information to Tate Officials which were sent to them from Author P.N. Elrod.  Tate’s Officials and legal team apparently followed Author P.N. Elrod’s activities on line for several months and gathered more than enough documentation to proceed with a civil action against her.

Apparently, Author P. N. Elrod was advised that should she continue her harassment, Tate Publishing would file suit immediately and use the alleged defamatory and inappropriate material against her and her web hosting company in Monterey, California (they would also be named in the lawsuit if required).

The anonymous source further indicated that Tate Publishing & Enterprises, LLC monitored Author P.N. Elrod’s activities and has complete records of each alleged statement of libel and defamation she has made against the company.  In addition, Tate Publishing apparently also has several authors who wish to be included in the lawsuit against Author P.N. Elrod for contacting them with incorrect, harassing and defaming information allegedly beyond opinion without credible facts.

TWA’s anonymous source stated that Tate Publishing is also aware of additional web site operations which Author P.N. Elrod apparently frequents and observes her statements of libel there as well.  Apparently, Tate’s legal team advised Author P.N. Elrod that that if her actions continue they will contact the legal department with Facebook about her actions, which may violate their standards.

TRW’s source stated that Author P.N. Elrod was given an ultimatum. In order to avoid civil action being filed against her the following was requested to be made within five (5) business days and confirmation to Tate’s legal team’s office: 1) Immediately stop contacting Tate staff, authors and prospective authors concerning Tate Publishing with her alleged defamation of their company and staff; and 2) Delete all current posts on the world-wide web concerning Tate Publishing and do not make any future posts.

TWA’s anonymous source indicated that Author P.N. Elrod sent back a certified copy of the letter noting that she has complied with all the demands. TWA has confirmed that the blogs/post have been removed. Apparently, no further action will be taken by Tate at this time.

TWA’s anonymous source indicated that Tate Publishing has taken this action and is preparing more legal action to those who have made such statements without credible facts.

EDITORIAL: THE DISGRACE OF WRITER BEWARE

Cyberbullying.  It’s now in the public consciousness.  But when and how did it get started?  A clue can  be found in the business community.

In the 90′s, when personal computers were still not yet in every household, the internet was virtually the wild wild West.  Anyone with a computer and access to the internet could  dominate their market.  This trend caught on in the business community.  Anyone could post negative or false information about their competitors without consequences.  This was the birth of cyberbullying.
In time, it trickled down to just about everyone. School children began to use computers, cell phones, etc. to bully their peers.

By 2005, Writer Beware had created a false literary agent named “Miss Snark” who was supposed to be a seasoned professional in New York City.  “Miss Snark” was used to “knock” certain businesses and to praise selected businesses.  “Miss Snark” and Writer Beware went onto as many web sites as possible to do damage to targeted businesses..  A “googlebomb” or linking strategy was used in order to cause the negative postings to appear in a search engine.  The negative postings would appear at the top of the page, and would make it impossible for anyone to find the business’s web site.

By 2006 Writer Beware and their affiliates had made it a practice to make any type of antisocial or terrorist threat without any consequences, claiming “lack of jurisdiction” when accused of bad behavior. An example was a  posting about a literary agent on Absolute Write, a Writer Beware affiliate, in which the posters (Jenna Glatzer and MacAlister Stone) were directing their readers to attack him and cut off his genitals. These types of terrorist threats were quite common on the web sites of Absolute Write, Writers Net, Speculations and Writer Beware.  In fact they are their customary way of doing business.

At around the same time in 2006, the rest of the world was also engaged in this type of activity, with people creating false identities to harass others.  2006 was the year of the suicide of Megan Meyer, a thirteen-year-old girl who hung herself in her bedroom closet because she had been rejected by a fictitious boy named “Josh Evans,” a creation of her neighbor down the street in her home town in Missouri.

Cyberbullying is now politically incorrect after the famous Tyler Clemente case in New Jersey.
But  Writer Beware continues along its merry way, because the law has not yet caught up to them.
Claiming to report literary fraud, (the terminally-ill with Cancer) Ann Crispin and Victoria Strauss and Richard White refused to cover the Charles Petit story when he was accused and punished by an Illinois Court for cheating the John Steinbeck estate because Petit was a frequent contributor (screen name “Jaws”) to blogs at Writer Beware, Absolute Write, Making Light, etc.   He was also the attorney for (the terminally-ill with Cancer) Ann Crispin, Victoria Strauss and Jenna Glatzer.

The majority of posters who follow Writer Beware appear to be unpublished authors who have not made the grade, or else fictitious renditions of Strauss, (the terminally-ill with Cancer) Crispin and their spouses…

How Pathetic Can Preditors & Editors David L. Kuzminski Be?

The quote above is the headline to the Preditors & Editors website. Seriously, how pathetic can David L. Kuzminski be? Asking authors to bail his tuches (ass) out with donations to fund his legal defense? We don’t need to tell you that authors are generally not the highest paid individuals. For David L. Kuzminski to ask for financial assistance from them is despicable. As you may know, a self-published author must sell approximately 5000 books before he/she breaks even. Considering David L. Kuzminski’s own Amazon Sales Rankings, it’s no wonder that he would solicit handouts for a legal problem that he alone created.

David L. Kuzminski, if you’re going to “give out information” at least back it up with primary source material. It’s not that some people “do not like P&E,” it is, however, the total lack of disregard of proving claims with demonstrative evidence that people don’t agree with. Unfortunately, in your case, it appears to have caught up with you. It’s your problem and it’s time for you, and only you, to face it. Again, to request struggling authors to financially support your legal defense is despicable. It reeks of the very same accusations you’ve made against various publishing companies. literary agents and individuals. It’s time to put your big boy pants on and face your own reality. If your experience contributes anything to the publishing world, perhaps it will be what not to do and solidify the need for using primary source material. If the low donations to the “Atlanta Nights” film project (and the dreadful Amazon Sales Rankings of the companion book) are any indication of author support, we would assume that few are supporting your plea. Please, stop begging from authors and remove this pathetic request for donations. Remember what “Uncle Jim” says, “money flows to the author.” However, it should not flow to the legal defense fund of another author.

Normally, only registered non-profit ((501 (c) (3)) organizations can solicit donations from the public. To do so otherwise can give rise to investigative curiosity from the Internal Revenue Servicestate agencies and the Attorney General’s office of any given state. We have not found any Articles of Incorporation, DBA’s, Assumed Names or IRS documentation which categorizes Preditors & Editors or David L. Kuzminski as a “public charity.” In addition, the Preditors & Editors website is registered under David L. Kuzminski and is not affiliated with any corporation, DBA or other business entity.
