Maybe? Sure, until the scam strikes at home base.In 2007 it did; and, it’s a SCAM of EPIC proportions. It involves the estate of Pulitzer Prize and Nobel Prize winning author John Steinbeck (i.e. The Grapes of Wrath (1939) and East of Eden (1952) and the novella Of Mice and Men (1937) . . . yes, that Steinbeck. Huge? We think so. Was the failure of Writer Beware™ to report this scam an oversight or a case where they just turned their heads and looked the other way?What did this scam involve? In principle, it’s the kind of material that Writer Beware™ built its foundation on. Exposing scams that are relative to: 1) engaging in conduct involving dishonesty, fraud, deceit, or misrepresentation; 2) breaching fiduciary duties to a client; 3) obtaining an unreasonable fee; and 4) engaging in conduct which tends to defeat the administration of justice or to bring the courts or the legal profession into disrepute. These are the types of claims that spawned Writer Beware™ and its own version of their boycotts; otherwise known as their “Thumbs Down” lists. It’s time for the “bright light” to shine into the “dark corners of the shadow-world” of Victoria Strauss, Ann “A.C.” Crispin, Writer Beware™ and the Science Fiction & Fantasy Writers (SFWA). There’s one name we will not see on any Writer Beware ™ list and we’ll let you decide exactly why that happened.He represented “people who claimed they were defrauded.” He also goes by “Jaws” on some of the infamous writer and author awareness blogs. He was also known as the “Authors Lawyer.” His ties to the Science Fiction & Fantasy Writers (SFWA), Writer Beware™, Ann “A.C.”Crispin and Victoria Strauss are well documented; he worked “closely” with them and had frequent correspondence with Teresa Nielsen-Hayden. He called Victoria Strauss a “colleague.” Who was this highly lauded “scamhunter”? Charles Emil Petit. Also known as Charles E. Petit, Charlie Petit and/or C.E. Petit. AKA “Jaws.”Charles E. Petit is also believed to be an Absolute Write contributor and frequent commenter on Writer Beware ™. Confidential sources indicated to The Write Agenda that, at one time, all complaints and “cease & desist” letters regarding Writer Beware™ were to be directed to Charles E. Petit. On information and belief, it appears that he did accept service of process for several defendants in the Bauer vs. Glatzer in 2007. Petit never actually represented any of the defendants. He couldn’t because he’s not licensed in New Jersey. He did accept service and then referred the case to local New Jersey attorneys. He was subjected to disciplinary action, by the Illinois Attorney Registration and Disciplinary Commission, after a complaint was filed by Nancy Steinbeck who was the former wife of John Steinbeck IV, the son of author John Steinbeck.As of this writing, Charles E. Petit has not made any effort at restitution or returning the fees that he collected from Nancy Steinbeck.

Writer Beware™ has always been “the” self-promotion site of choice for Ann “A.C.” Crispin and Victoria Strauss.

To quote Ann “A.C.” Crispin:

We recently posted the article A.C. Crispin is Begging for “Volunteers” to Write Reviews for Her Bookswe couldn’t help to note the irony of Victoria Strauss’ January 23, 2013 posting on Facebook.

Upon reviewing Victoria’s latest attempt at writing, Passion Blue (“Passion Blew”), speaking of “[f]ake postive reviews, the 15 Five Star Reviews are quite illuminating. Among the 15 Five Star Reviews who did we find? None other than Michael Capobianco! Yes, that Michael Capobianco . . . the notorious husband of Ann “A.C.” Crispin dishing out Five Star Reviews of Strauss’ Passion Blew! Just so you new authors are aware, Michael Capobianco is a former President of the SFWA. In addition, Capobianco also attempted to discredit our reporting of the C.E. Petit scandal regarding the John Steinbeck family (see below). (See  John Steinbeck Family Defrauded by Writer Beware™ & SFWA Attorney: The 2007 Scam that Writer Beware™ Didn’t Report . . . Why?) Intrestingly, the Five Star book review of Strauss’ book by Capobiano is the only book review he’s ever submitted on Amazon (see below  . . .  click on the images to enlarge).

Now, it gets even more disingenuous. Reviewing the remaining 14 Five Star Reviews most have not reviewed any other books . . .  just Strauss’ Passion Blew. As you page down further who do you find? Well, a Five Star Review from none other than . . . you guess it . . . Ann “A.C.” Crispin:

Granted they qualified their postings. However, as we stated in our A.C. Crispin is Begging for “Volunteers” to Write Reviews for Her Books posting, when you ask “friends” to write reviews about your book(s)  . . .  isn’t it disingenuous?

If their books were selling then the general public would be posting “genuine” reviews of their books . . .  not fabricated  (i.e. “fake positives”) reviews generated from “flying monkeys” at the behest of authors Ann “A.C.” Crspin and Victoria Strauss. Begging for book reviews? Oy!  . . . the hypocrisy! Authors don’t beg for reviews . . . if the work is good the general book buying public will evaluate it on its own merits. Crispin, Strauss & Capobianco should know better.

Transparency is everything. Just ask the President of the Science Fiction Writers of America (SFWA)  . . .  i.e. John “No Balls” Scalzi. Why was there such a long delay in filing the organizations tax returns and annual reports. What say you John “No Balls” Scalzi?

The Write Agenda is pleased to see that the Science Fiction Writers of America (SFWA) has become increasingly more prudent in filing their tax returns and Annual Reports. We are pleased to share with you the tax returns of the Science Fiction Writers of America (SFWA) from 2010 – 2012. We’re not certain if our previous articles (below) stimulated its President (John “No Balls” Scalzi) into action or not. However, the organization (SFWA) now appears to be in compliance with State and Federal agencies.

Tate Publishing & Enterprises, LLC Slams Author P.N. Elrod With a “Another” Cease & Desist Order

An anonymous source has advised The Write Agenda™ (TWA) that Author P.N. Elrod was hit with “another” cease and desist order.

Apparently, numerous Tate Publishing authors, with Facebook and other electronic services, provided information to Tate Officials which were sent to them from Author P.N. Elrod.  Tate’s Officials and legal team apparently followed Author P.N. Elrod’s activities on line for several months and gathered more than enough documentation to proceed with a civil action against her.

Apparently, Author P. N. Elrod was advised that should she continue her harassment, Tate Publishing would file suit immediately and use the alleged defamatory and inappropriate material against her and her web hosting company in Monterey, California (they would also be named in the lawsuit if required).

The anonymous source further indicated that Tate Publishing & Enterprises, LLC monitored Author P.N. Elrod’s activities and has complete records of each alleged statement of libel and defamation she has made against the company.  In addition, Tate Publishing apparently also has several authors who wish to be included in the lawsuit against Author P.N. Elrod for contacting them with incorrect, harassing and defaming information allegedly beyond opinion without credible facts.

TWA’s anonymous source stated that Tate Publishing is also aware of additional web site operations which Author P.N. Elrod apparently frequents and observes her statements of libel there as well.  Apparently, Tate’s legal team advised Author P.N. Elrod that that if her actions continue they will contact the legal department with Facebook about her actions, which may violate their standards.

TRW’s source stated that Author P.N. Elrod was given an ultimatum. In order to avoid civil action being filed against her the following was requested to be made within five (5) business days and confirmation to Tate’s legal team’s office: 1) Immediately stop contacting Tate staff, authors and prospective authors concerning Tate Publishing with her alleged defamation of their company and staff; and 2) Delete all current posts on the world-wide web concerning Tate Publishing and do not make any future posts.

TWA’s anonymous source indicated that Author P.N. Elrod sent back a certified copy of the letter noting that she has complied with all the demands. TWA has confirmed that the blogs/post have been removed. Apparently, no further action will be taken by Tate at this time.

TWA’s anonymous source indicated that Tate Publishing has taken this action and is preparing more legal action to those who have made such statements without credible facts.
